A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

Your Personal Data

What information do we need?

·¬ÇÑÊÓƵapp Council will act as the ‘Data Controller’ in regard to the personal data you provide to us as part of this tender process. The Data Protection Officer, who is responsible for ensuring personal data is managed in accordance with data protection legislation, can be contacted as follows:

The information we collect from you will include: your name; address; email address; phone number; professional memberships, accreditations, certifications and registrations; educational qualifications and certifications; and history of previous employment.

Unless specifically agreed with you, we will only collect personal data about you which does not include any special categories of personal information about you (also known as ‘sensitive personal data’.

Why we need this information?

Your information is being collected for the following purpose(s):-

To allow us to perform the major project client management function of the Council in regard to the selection, appointment and management of suitably qualified and experienced bidders who offer, and contractors and/or consultants subsequently commissioned to, execute works, supply products or provide a service. This includes private companies, sole traders and the third sector and supported businesses, all also known as economic operators, in terms of the Public Contract (Scotland) Regulations 2015.

If you do not provide this information then we will be unable to progress with the assessment and evaluation of your European Single Procurement Documentation, and/or, Tender Submissions and/or any subsequent Contract Award. .We will not collect any personal data from you that isn’t needed for the major projects client management process.

The lawful basis for collecting your information in these circumstances is:-

Legal obligation: processing is necessary for compliance with the requirements of the:

  1. Public Contract (Scotland) Regulations 2015; and
  2. The Construction (Design and Management) Regulations 2015

Public task: processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council.

What we will do with your information

Your information will be shared with the recipients or categories of recipients listed below:-

  • ·¬ÇÑÊÓƵapp’s Major Projects Client Management Team
  • ·¬ÇÑÊÓƵapp’s Procurement Team
  • ·¬ÇÑÊÓƵapp’s Corporate Health and Safety Team
  • Other ·¬ÇÑÊÓƵapp Council Services involved in the management, supervision and administration of major projects
  • Police Scotland for the purposes of prevention and detection of crime and for ensuring compliance with mandatory and discretionary exclusions to the extent that such information may be disclosed by law.
  • Any relevant Council Officer, contractor or consultant who is involved in delivery of the Councils’ Major Projects Client Management Service

You should also be aware that your data will be stored on servers located within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website () or can be provided in paper format on request to data.protection@

How long will we keep your information?

If you appointed as a contractor, supplier or consultant on a major project, we will keep your information for the duration of the contract and for 12 years after contract end unless the project is in receipt of European funding, where the retention period may vary depending upon the funding programme

If you are a bidder for a public works, services or supply contract we will keep your information for the duration of the contract whether you are successful or not and for 5 years after contract end unless the project is in receipt of European funding, where the retention period may vary depending on the funding programme.

Automated Decision Making

No automated decision making will take place.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the legal basis specified above is consent (not applicable)
  • to lodge a complaint with the Information Commissioner’s Office – see below for details
  • to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract (not applicable)
  • to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
